Poor nutrition habits have been reported in the childcare setting. While the literature advocates the need to carry out ‘Voice of the Child’ research, few studies have explored this methodology with regard to children and food, in particular in the pre-school setting. This article aims to outline the ethical issues raised by a research ethics committee and to discuss the impact of these issues on a study that hoped to determine the food perceptions of children (aged three to four years) (...) within an ongoing nutrition and lifestyle pre-school project in Ireland. Ethical approval was granted for this study but only upon the clarification of two aspects: that only hedonic symbols previously used in the literature could be included in the study; and that parental consent be obtained from both parents of each child. Children were shown food pictures and asked to use the hedonic symbols to answer questions posed to them on the food. Owing to the ethical constraints imposed by the requirement for two-parent consent, seven children, from a potential sample of 85, were eligible to partake in the study. These children did not seem to understand the hedonic symbols recommended for use by the ethics committee, therefore preventing the collection of in-depth qualitative data. The ethical constraints placed on this study impacted on both its design and its methodology and are discussed in relation to national and international ethical guidance and legislation. Future research with children regarding food choice must balance the need for strict ethical standards with the need to explore children’s views on this subject. (shrink)

Hardback, xii + 220 pp. ISBN 978-1-4744-9319-2.Utopian Studies readers first saw Stephanie Peebles Tavera’s work in print in her 2018 essay on reproductive health in Charlotte Perkins Gilman’s Herland. More (...) recently, in (P)rescription Narratives, she gives readers a view of the much broader historical scope of her scholarship in literary and cultural studies. Tavera’s analysis of what she labels “feminist medical fiction” considers not only novels and short stories but also literary reviews, dramas, and documentary films, many of which will be unfamiliar to readers of utopian and dystopian literature. Yet the book contextualizes the ways in which these works capture the “utopian possibilities” of women writers who pushed for breaking the boundaries of the dystopian strictures of embodied life. The literary works “rescript” what had been prescribed by others as “normalized behavior,” from the latter-nineteenth century through the Progressive Era (5, 37). As Tavera illustrates through her detailed analysis, these women’s narratives provide “interventions that... interrupt the dissemination of false [End Page 612] narratives of the female body” and “alter the course of cultural development toward greater inclusivity” (5).To establish the temporal boundaries for the project, Tavera emphasizes the Comstock Law, established in 1873, and the death of its author Anthony Comstock in 1915. While Comstock’s work often has been understood as restricting pornography, she explains the Comstock Law as more than merely that. Comstock sought to control what he and others saw as sexual deviation, which included birth control in any form. Tavera also bookends the project with lawsuits associated with Victoria Woodhull and Margaret Sanger, both women who advocated for abortion and birth control as means of allowing women to avoid the strictures over their bodies. Additionally, she explains, Comstock’s racism caused him to completely overlook Black women, ironically allowing a space in which Black women’s feminist medical fiction especially rescripts “normalized behavior” (37)—a topic she pursues in two parts of the book.The book follows a roughly chronological path as it examines four topics related to women’s health, brilliantly organized into “(p)rescriptions,” indicated by Rx, rather than chapters with numbers. Rx1, “Crip Medicine,” illustrates how authors such as Charlotte Perkins Gilman pointed to the socially constructed status of “hysteria” in a patriarchal culture that saw women as deviant by nature. Instead, these authors advocated for a more holistic examination of women’s health, impacted by the environments in which they lived. Drawing from Lyman Tower Sargent’s widely accepted view of utopianism as dreaming of a place “considerably better than the society in which the author lived,” she underscores “the utopian impulse underlies much of the work of feminist medical fiction” (39). In particular, writers of feminist medical fiction were “driven by failure.”Perhaps most familiar to illustrate this point is Gilman’s work, such as “The Yellow Wallpaper,” which illustrated how the culture failed certain characters. The narrator of that story suffers postpartum depression and is made worse by Dr. S. Weir Mitchell’s rest cure. Consequently, Gilman proceeded to write other works, such as Moving the Mountain (1911) and then Herland (1915), which push readers to envision “alternative societies” without such destructive patriarchal medical practices (39). But Tavera also explains how Louisa May Alcott’s Eight Cousins, or the Aunt-Hill (1875) critiques contemporary culture by providing a “domestic utopia” in the female domain of Aunt-Hill, wherein the male Dr. Alec Campbell demonstrates “a better way... of caring for the female body” (55). And another key example is Rebecca Harding [End Page 613] Davis’s Kitty’s Choice: A Story of Berrytown (1875). Berrytown is described as “the Utopia in actual laths, orchards, and bushel-measures of the advance guard of the reform party in the United States” (qtd. in Tavera 55). In this article, I consider the harms inflicted upon transgender persons through “misgendering,” that is, such deployments of gender terms that diminish transgender persons’ selfrespect, limit the discursive resources at their disposal to define their own gender, and cause them microaggressive psychological harms. Such deployments are morally contestable, that is, they can be challenged on ethical or political grounds. Two characterizations of “woman” proposed in the feminist literature are critiqued from this perspective. When we consider what would happen to transgender (...) women upon the broad implementation of these characterizations within transgender women’s social context, we discover that they suffer from two defects: they either exclude at least some transgender women, or else they implicitly foster hierarchies among women, marginalizing transgender women in particular. In conclusion, I claim that the moral contestability of gender-term deployments acts as a stimulus to regularly consider the provisionality and revisability of our deployments of the term “woman.”. There are two main theoretical frameworks in statistical mechanics, one associated with Boltzmann and the other with Gibbs. Despite their well-known differences, there is a prevailing view that equilibrium values calculated in both frameworks coincide. We show that this is wrong. There are important cases in which the Boltzmannian and Gibbsian equilibrium concepts yield different outcomes. Furthermore, the conditions under which equilibriums exists are different for Gibbsian and Boltzmannian statistical mechanics. There are, however, special circumstances under which it is true (...) that the equilibrium values coincide. We prove a new theorem providing sufficient conditions for this to be the case. (shrink)

This book develops an account of what substance is in terms of the notion of independence. As the authors note, there is a tradition of defining substance as independent that begins with Aristotle. But what notion of independence can provide an adequate definition of substance? The authors find traditional attempts to define independence, including Aristotle’s, inadequate on a number of grounds, and they propose an alternative account. This article examines initial-condition dependence and initial-condition uncertainty for climate projections and predictions. The first contribution is to provide a clear conceptual characterization of predictions and projections. Concerning initial-condition dependence, projections are often described as experiments that do not depend on initial conditions. Although prominent, this claim has not been scrutinized much and can be interpreted differently. If interpreted as the claim that projections are not based on estimates of the actual initial conditions of the world or that what makes (...) projections true are conditions in the world, this claim is true. However, it can also be interpreted as the claim that simulations used to obtain projections are independent of initial-condition ensembles. This article argues that evidence does not support this claim. Concerning initial-condition uncertainty, three kinds of initial-condition uncertainty are identified. The first is the uncertainty associated with the spread of the ensemble simulations. The second arises because the theoretical initial ensemble cannot be used in calculations and has to be approximated by finitely many initial states. The third uncertainty arises because it is unclear how long the model should be run to obtain potential initial conditions at pre-industrial times. Compassion in healthcare has received significant attention recently, on an international scale, with concern raised about its absence during clinical interactions. As a concept, compassionate care has been linked to nursing. We examined historical discourse on this topic, to understand and situate current debates on compassionate care as a hallmark of high‐quality services. Documents we looked at illustrated how responsibility for delivering compassionate care cannot be consigned to individual nurses. Health professionals must have the right environmental circumstances to be able (...) to provide and engage in compassionate interactions with patients and their relatives. Hence, although compassionate care has been presented as a straightforward solution when crisis faces health services, this discourse, especially in policy documents, has often failed to acknowledge the system‐level issues associated with its provision. This has resulted in simplistic presentations of ‘compassion’ as inexpensive and the responsibility of individual nurses, a misleading proposal that risks devaluing the energy and resources required to deliver compassionate care. In practice, MNEs often struggle to cope with the complexity of these governance gaps, and PCSR does not provide a clear definition nor offer guidance for how to analyze and address them. By adopting the notion of governance mechanisms from GVC literature, this (...) study proposes a more nuanced view, in which governance gaps result from inactive, ineffective, or inequitable governance mechanisms adopted by relevant actors, rather than a complete absence of governance. MNEs, through their governance mechanisms, commonly create governance gaps. This study distinguishes different types of governance mechanisms to create a typology of governance gaps, such that it contributes to the literature on PCSR by offering a more refined understanding of governance gaps, along with a means to identify mechanisms to address them. In the third Critique Kant details an aesthetic operation of judgment that is surprising considering how judgment functioned in the first Critique. In this book, I defend an understanding of Kant’s theory of Geschmacksurteil as detailing an operation of the faculties that does not violate the cognitive structure laid out in the first Critique. My orientation is primarily epistemological, elaborating the determinations that govern the activity of pure aesthetic judging that specify it as a "bestimmte" type of judgment without transforming (...) it into "ein bestimmendes Urteil". I focus on identifying how the logical functions from the table of judgments operate in the pure aesthetic judgment of taste to reveal "the moments to which this power of judgment attends in its reflection". In the course of doing so, a picture emerges of how the world is not just cognizable in a Kantian framework but also charged with human feeling, acquiring the inexhaustible, inchoate meaningfulness that incites "much thinking". The universal communicability of aesthetic pleasure serves as the foundation that grounds robust intersubjective relations, enabling genuine connection to others through a shared a priori feeling. Substance and Essence in Aristotle is a close study of Aristotle's most profound—and perplexing—treatise: Books VII-IX of the Metaphysics. These central books, which focus on the nature of substance, have gained a deserved reputation for their difficulty, inconclusiveness, and internal inconsistency. Despite these problems, Witt extracts from Aristotle's text a coherent and provocative view about sensible substance by focusing on Aristotle's account of form or essence. After exploring the context in which Aristotle's discussion of sensible substance takes place, Witt turns (...) to his analysis of essence. Arguing against the received interpretation, according to which essences are classificatory, Witt maintains that a substance's essence is what causes it to exist. In addition, Substance and Essence in Aristotle challenges the orthodox view that Aristotelian essences are species-essences, defending instead the controversial position that they are individual essences. Finally, Witt compares Aristotelian essentialism to contemporary essentialist theories, focusing in particular on Kripke's work. She concludes that fundamental differences between Aristotelian and contemporary essentialist theories highlight important features of Aristotle's theory and the philosophical problems and milieu that engendered it. Equilibrium is a central concept of statistical mechanics. In previous work we introduced the notions of a Boltzmannian alpha-epsilon-equilibrium and a Boltzmannian gamma-epsilon-equilibrium. This was done in a deterministic context. We now consider systems with a stochastic micro-dynamics and transfer these notions from the deterministic to the stochastic context. We then prove stochastic equivalents of the Dominance Theorem and the Prevalence Theorem. This establishes that also in stochastic systems equilibrium macro-regions are large in requisite sense.

The aim of the article is to provide a clear and thorough conceptual analysis of the main candidates for a definition of climate and climate change. Five desiderata on a definition of climate are presented: it should be empirically applicable; it should correctly classify different climates; it should not depend on our knowledge; it should be applicable to the past, present, and future; and it should be mathematically well-defined. Then five definitions are discussed: climate as distribution over time for constant (...) external conditions; climate as distribution over time when the external conditions vary as in reality; climate as distribution over time relative to regimes of varying external conditions; climate as the ensemble distribution for constant external conditions; and climate as the ensemble distribution when the external conditions vary as in reality. The third definition is novel and is introduced as a response to problems with existing definitions. In this paper, I invoke various matterings of felt in order to generate a practice of writing that engenders bodily difference that is affective, moving, and wooly. In attending to ‘how to write as felt,’ as a touching encounter, I consider how human and nonhuman matter composes. This co-mingling that felt performs enacts what Alaimo calls transcorporeality. Connecting felt with theories of touch and transcorporeality becomes a way to open up and re-configure different bodily imaginaries, both human and nonhuman, that (...) are radically immanent and intensive; as an assemblage of forces and flows that open bodies to helices and trans connections :27–58, 2017b). My contribution to this collection on ‘humanity in a posthuman age’ is experimental and performative. Felt is activated not as a metaphor but rather poses questions about what writing does at the interstices between research and creation. (shrink)

David Lewis famously argued that the time traveller ‘can’ murder her grandfather, even though she never will: it is compossible with a particular set of facts including her motive, opportunity and skill . I argue that while ordinary agents ‘can’ under Lewis’s conception, philosophers cannot – the latter will not only fail to fulfill their homicidal intentions but also fail to form them in the first place.

In pluralist societies, stakeholders in healthcare may have different experiences of and moral perspectives on health, well-being, and good care. Increasing cultural, religious, sexual, and gender diversity among both patients and healthcare professionals requires healthcare organizations to address these differences. Addressing diversity, however, comes with inherent moral challenges; for example, regarding how to deal with healthcare disparities between minoritized and majoritized patients or how to accommodate different healthcare needs and values. Diversity statements are an important strategy for healthcare organizations to (...) define their normative ideas with respect to diversity and to establish a point of departure for concrete diversity approaches. We argue that healthcare organizations ought to develop diversity statements in a participatory and inclusive way in order to promote social justice. Furthermore, we maintain that clinical ethicists can support healthcare organizations in developing diversity statements in a more participatory way by fostering reflective dialogues through clinical ethics support. We will use a case example from our own practice to explore what such a developmental process may look like. We will critically reflect on the procedural strengths and challenges as well as on the role of the clinical ethicist in this example. (shrink)

Historically, biocentrists have ascribed interests to organisms via an account of function. One promising account of function for this purpose is the organizational or autopoietic account of function, according to which some entity x has a function of self-maintenance when the parts of x contribute to the goal of self-maintenance. In this paper, I will present the autopoietic account of interests and provide some reasons for thinking that this account is promising. I will also present a possible issue for the (...) biocentrist who uses the autopoietic account of function given the following two claims: what it means to be a biological “self” is ambiguous, and the autopoietic account of interests relies on a self boundary. I argue that the proponent of this account then needs to choose a definition of individual and explain why that definition is morally relevant. Otherwise, the proponent of the autopoietic account has not given an account of what constitutes a harm or a benefit for a biological individual, and there are good reasons to believe that this is a necessary component of any account of interests. According to the Spatial Quantity Association of Response Codes (SQUARC), people hold a mental association between horizontal position and quantity (lower quantities left, higher quantities right). While a large body of research has explored this effect for response speed and judgment accuracy, the affective downstream consequences of the SQUARC remain unexplored. Aiming to address this gap, the present two experiments (pre-registered, total N = 521) investigated whether stimulus arrangements that are compatible with the SQUARC for luminance are affectively preferred to (...) stimulus arrangements that are incompatible. SQUARC-compatible square arrangements (dark-left, bright-right) were preferred over SQUARC-incompatible square arrangements (dark-right, bright-left). The preference for SQUARC compatibility was not moderated by the horizontal orientation of the response scale. Our results confirm the direction of the spatial-luminance association and provide initial support that the cognitive processing of SQUARC compatibility is hedonically marked and appears sufficient to impact affective evaluations. This paper attempts a rational reconstruction of the Humean notion of an ideal critic. Claiming that the traits of practice and comparison can only arise through the gradual accumulation of experience, I argue that Humean critics are real, not ideal. After discussing the nature of perfection and the relation of delicacy to the other Human traits, I propose two supplements to Hume's list: imaginative fluency and emotional responsiveness. The unpredictability of the development and results of a research program is often invoked in favor of a free, desinterested science that would be led mainly by scientific curiosity, in contrast with a use-inspired science led by definite practical expectations. This paper will challenge a crucial but underexamined assumption in this line of defense of scientific freedom, namely that a free science is the best system of science to generate unexpected results. We will propose conditions favoring the occurrence of unexpected (...) facts in the course of a scientific investigation and then establish that use-inspired science actually scores better in this area. Drawing on methodological approaches used by visual anthropologists, film theorists and debates prevalent in the cultural studies literature, this paper is interdisciplinary in approach and attempts to tackle the challenge of collecting and analyzing embodied, sensuous and pre-reflective ‘data’ by advocating the value of integrating videography into research methodologies. The paper is illustrated with an examination of underwater videography footage, featuring scuba divers coming to terms with their surroundings. By considering the ways in which those featured in the film relate (...) to the onscreen images, upon watching the footage, the paper explores how we might begin to study and represent the ‘unrepresentable’ senses of, for example, touch and the somatic senses, including proprioception, in addition to the heightening or modification of these. Against the background of South Africa’s ‘official’ policy of multilingualism, this study explores some of the socio-cultural dynamics of English as a lingua franca (ELF) in relation to how cosmopolitanism is understood in South Africa. More specifically, it looks at the link between ELF and cosmopolitanism in higher education. In 2016, students at Stellenbosch University (SU) triggered a language policy change that enacted English (as opposed to Afrikaans) as the primary medium of teaching and learning. English has won recognition as (...) the academic lingua franca for at least two socio-political reasons: First, English is considered more ‘neutral’ than Afrikaans (which continues to be strongly associated with Afrikanerdom), and second, English is arguably associated with cosmopolitanism and an international institutional status. Despite English being the academic lingua franca, it continues to be caught in an ambivalent climate with tensions among policy planners, language practitioners, higher education managers, academic staff and students. Ultimately, this paper argues that ambiguity is one of the most defining features of English in South Africa and that a complex range of Cosmopolitan, Afropolitan and glocal African identity trajectories reflect the power dynamics of English in the country. Cognitive‐enhancing drugs are prescribed to patients with psychiatric disorders, such as attention deficit hyperactivity disorder (ADHD) and Alzheimer's disease, to treat cognitive deficits. This chapter discusses the use of pharmacological agents to improve the cognition of both those with cognitive impairments and of the general population, as well as some of the benefits, risks, and ethical issues associated with the use of cognitive‐enhancing drugs. The chapter also talks about a survey run by the journal Nature, which was prompted by a (...) commentary by the authors of this chapter, that asked readers for their views on the issues surrounding cognitive enhancement. It can be seen that the ethical issues surrounding the use of cognitive‐enhancing drugs are complex and require discussion among different groups. With the development of new drugs and methods of enhancing cognition, such as brain stimulation, the need for further research and discussion is likely to become more pressing. (shrink)

In July 2019, Stella Creasy MP and her team succeeded in attaching an amendment to a largely administrative bill which would require the UK government to liberalise abortion laws in Northern Ireland by 21 October 2019, provided the Northern Ireland government does not resume before that date.1 The amendment succeeded in the Commons, 332 votes to 99 and later, with some adjustments, in the Lords, 182 votes to 37. The Bill received Royal Assent on 24 July 2019. In Northern Ireland, (...) abortion remains a criminal offence punishable by up to life imprisonment in all except exceptional circumstances, that is, where it is ‘necessary to preserve the life of the woman’ or where there is a ‘risk of serious adverse effect which is either long term or permanent’.2 The law makes no provision for women who are pregnant as a result of rape, incest or in the case of fatal fetal abnormality. Because there is a lack of clarity around which circumstances or conditions would have a sufficiently ‘serious and long-term adverse effect’, it has been argued that the law has had a ‘chilling effect’ on service provision.3 As a result, only 13 abortions were performed in Northern Ireland in 2018/2019.4 Instead, more than 1000 women travelled from Northern Ireland to England to access legal abortion services.5 A recent review of the law in Northern Ireland concluded that this situation disadvantages women who cannot afford to or are unable to travel.3 Women are also reportedly purchasing abortifacients unlawfully online, exposing them to the risk of prosecution as well as to risks where the pills are unsafe or lead to complications. The British Medical Association and Royal College of Physicians have published new guidance, endorsed by the General Medical Council, on decision-making about clinically assisted nutrition and hydration and adults who lack capacity to consent. The development of the guidance follows a series of legal cases which has created confusion about the precise circumstances in which an application to the court is required before CANH is withdrawn which has culminated with the decision of the Supreme Court in National Health Service Trust (...) versus Y. 1 This confirmed that there is no requirement to go to court, providing there is agreement as to the patient’s best interests, the provisions of the Mental Capacity Act 2005 have been observed, and the relevant professional guidance has been followed. The new guidance covers all decisions to start, restart, continue, or stop providing CANH in patients who are not imminently dying, in circumstances where CANH is the primary life-sustaining treatment being provided. It goes beyond the category of patients in permanent vegetative state or minimally conscious state who have previously been the subject of court applications, and also covers decisions for patients with neurodegenerative conditions and patients who have suffered a sudden onset brain injury in addition to having multiple comorbidities or general frailty which is likely to impact on life expectancy. It provides a clear statement of doctors’ legal responsibilities, covers the importance of robust best interests’ assessments and sets out the process to be followed for sufficient independent scrutiny of decisions. In light of some of the identified problems with decisions about CANH, a particular focus of the guidance is on the importance of regular best interests’ assessments, and it provides detailed practical guidance about how to approach these. Each paper was read (...) beforehand; and to guide the discussion, each session was begun by a respondent.It was reported at the first session that the 2000 IBCTE will take place August 3-6 at Tacoma, Washington just prior to the Society for Buddhist-Christian Studies International Conference on "Buddhism, Christianity, and Global Healing." The theme for next year's encounter will be "The Economic Factors in Social and Environmental Violence." This theme will build on the dialogue generated by the topics of the previous two years, namely, environmental and social violence. Papers will be prepared by Sulak Sivaraksa, John B. Cobb, Jr., Judith Simmer-Brown, and Carol Johnston. Responses will be made by Stephanie Kaza, David Chappell, Valerie Karras, and Terry Muck.It was also announced at that session that six of our membership will present a panel on the IBCTE at the Parliament of the World's Religions in Cape Town, South Africa in December 1999. That panel will share the fruits of the 15-year history of the IBCTE. Those who will attend this Parliament are: David Lochhead, David Chappell, Schubert Ogden, the Ven. Yifa, Judith Simmer-Brown, and Rosemary Ruether.The following is a summary of each of the eight dialogue sessions at the 1999 meeting: First Paper (April 16 Morning Session) Discussion began with Taitetsu Unno's response to David Lochhead's paper entitled, "Monotheistic Violence." Unno began by examining the relationship between deep personal faith (vertical) and the social/ethical elements of religion (horizontal). This led to further discussion on violence and the construction of "the other." Unno raised the questions: Who decides what constitutes the other? Further, who ultimately [End Page 241] decides if the other is or is not enemy/neighbor? Unno pointed out that, following Matthew 5, if God does not discriminate good from evil, then who can determine who is just and unjust? This comment pointed to the great problem for minorities in North American society.Unno also made some comments on Lochhead's use of liberation theology: If all economic systems are prone to misuse, then does a critique of capitalism do us much good?Lochhead's reply to Unno began with the issue of dualism and non-dualism. Here, Lochhead talked about a "soft" dualism, in that our world is constituted by relationships such that God and neighbor are the names that appear in this discourse. Like Martin Buber's path in I and Thou, dualistic construction comes out of relationships. Lochhead clarified that this dualism is not the same as a hard dualism, which is what Unno referred to as subject/object dualism. This led to the relevant question: What kind of violence is involved in the construction of the other? If God is a name for something beyond me, then how can the construction of the self in relationship to God be a form of violence? And would not this nonviolent, soft dualistic construction hold for any other person or living being? Lochhead then suggested that it is when relationships somehow degenerate into I-it, in Buber's terms, that the construction can become violent.Much rich insight was brought to light when the dialogue opened for general discussion. José Cabezón asked if violence demands the construction of the other? He pointed out that for the human realm differentiation is necessary for human life. Stephanie Kaza contributed to the discussion by suggesting that biological necessity is very hard for people to understand. There can be different bases of knowing, and religious knowing is from a privileged point of view for understanding our relationship with the natural environment. Last year the Department of the Environment, Food and Rural Affairs (DEFRA) released a new set of revised guidelines upon environmental reporting practices for U.K companies. Two industrial sectors were selected – the Water industry and the Energy industry – and the most recent Environmental Reports produced by companies in these sectors were subjected to content analysis where the coding framework was heavily based on the DEFRA guidelines. Results are reported for the two industries separately and the two industries are (...) also compared. Whilst sectoral differences were found it was clear that many companies addressed most of the issues raised in the guidelines. However, others did not. Whilst no conclusions can be made about the quality of reporting the main areas of emphasis in each sector can be determined. (shrink)

This paper analyzes the legal issues associated with the leading and much-debated proposals that aim to revitalize state regulatory competition and allow individuals to purchase insurance across state lines. These proposals seek to reverse decades-old principles of state preeminence in the regulation of individual health insurance and instead create “jurisdictional competition” in the individual market by allowing an insurer to choose the state under whose law it wishes to be regulated, subject to certain consumer protections. Advocates say this type of (...) jurisdictional competition would reform perceived problems in the individual market and lower the costs of individual health insurance by imposing the regulatory authority of only the insurer’s selected “home” state.
